Unfortunately, this loan would raise the borrower’s total line above the state’s legal lending limit. No need to fret, you think. You think a loan secured by the borrower’s million-dollar CD would not be counted as part of the line for legal lending limit purposes. You want to make sure, however, before responding to the borrower. You can find the answer to this question, and other useful information, on the Web site of the State Bank Department at: http://www.arkansas.gov/bank. From the “home page” of this site, you can link to General Information & Publications to check something out in the self-examination manual or go to Application Forms to print a blank branch application. Perhaps you have to Text Box: reach somebody in the Department’s Fayetteville office. Simply click on the How to Contact Us link. Click on the Links link for a shortcut to such Web sites as the American Bankers Association, FDIC and Federal Reserve. Oh, yes, we almost forgot. What about that CD? From the Bank Department home page, click on the link to Rules, Regs & Policies. Next, click on State Bank Department Rules & Regulations. When this manual appears on screen, use a Find or Search feature to look for the term, “certificate of deposit.” You should quickly find a listing in the table of contents for “Loans secured by certificate of deposit” on Page R5.3.
