Formation of the Commission
In 1969 the Arkansas General Assembly adopted Act 641 “The Arkansas Water Well Construction Act”. The Water Well Act created the Arkansas Water Well Construction Commission, which is responsible for the regulation of drilling operations as well as pump installation in the state. The Commission was composed of 7 members, the director of the Department of Health, the director of the Arkansas Geology Commission, and director of the Arkansas Soil and Water Conservation Commission. The remaining 4 members were by trade water well drillers, one from each congressional district. In 1995 the Assembly adopted ACT 840, which restructured the membership of the commission. The commission would still contain the 7-member panel, however a representative from the heat pump industry would replace the director of the Geology Commission. The 4-member driller panel would be divided into 2 drillers who are located Northwest of the fall line, and 2 drillers located Southeast of the fall line.
