Recently Adopted Rule Changes

Changes to qualifications for certified appraisers who supervise trainees

At its March 28, 2013 meeting, the Arkansas Appraiser Licensing and Certification Board approved for the second time these changes to its rules and regulations. The public comment period has ended. The rule will be filed with the Arkansas Secretary of State and the Arkansas State Library.

This rule pertains to the status of state certified appraisers who supervise trainees (State Registered Appraisers).

This rule will become effective July 1, 2013.

Proposed amendments to the "STATE OF ARKANSAS APPRAISER LICENSING AND CERTIFICATION BOARD RULES AND REGULATIONS (EFFECTIVE JANUARY 1, 2010)"

The current Section XI(A)(5) of the Board’s Rules and Regulations would be stricken in its entirety. To be stricken:
5. A certified appraiser who is otherwise qualified for supervising trainees who has been disciplined by the Board could be subject to one or more of the following according to the nature and severity of the violation;
(a) Prohibited from supervising a trainee;
(b) A restriction placed on the number of trainees that he/she may supervise; and/or:
(c) Be required to take additional courses approved by the Board before being permitted to supervise a trainee.

A new Section XI(A)(5) would be inserted. To be inserted:
5. The supervising State Certified Appraiser shall be in good standing and not subject to any disciplinary action within the last three (3) years that affects their ability to practice.

At its April 17, 2013 meeting, the Arkansas Appraiser Licensing and Certification Board approved for the second time these changes to its rules and regulations. The public comment period has ended. The rule will be filed with the Arkansas Secretary of State and the Arkansas State Library.

Proposed amendments to the "STATE OF ARKANSAS APPRAISER LICENSING AND CERTIFICATION BOARD RULES AND REGULATIONS (EFFECTIVE JANUARY 1, 2010)"

Change No. 1. The current Section II(B) of the Board's Rules and Regulations would amended as follows (underline indicates new text):

B. The applicant shall meet the current educational and experience requirements for licensing or certification prior to the time he or she applies to sit for the licensing or certification exam.
1. Prior to applying to become a State Registered Appraiser, the applicant must meet the requirements of Section VI(A)(3).

Change No. 2. A new Section VI(A)(3) would be inserted and would state:

3. As the prerequisite for application, an applicant must have completed 75 creditable hours of qualifying education as specified by the Appraisal Qualifications Board (AQB). Applicants must pass the course examinations and pass the 15-Hour National USPAP Course (or its AQB-approved equivalent) and examination as part of the 75 creditable hours. All qualifying education must be completed within the five (5) year period prior to the date of submission of a Trainee (State Registered) Appraiser application.

Change No. 3. Section X(C) would be deleted.

Change No. 4.The current section X(D) would be renamed X(C).
